Estate Plan HQ | Engagement Terms
These terms explain how we work together, what you can expect from us, and what we expect from you.
1. Scope of Services
EPHQ will draft and deliver estate-planning documents based upon the plan you select and provide up to two revision rounds with signing instructions. Services are limited to the preparation of estate planning documents governed by the laws of Virginia, the District of Columbia, Maryland, or West Virginia, as applicable to your jurisdiction of domicile. EPHQ does not represent clients domiciled outside of these jurisdictions.
2. Attorney-Client Relationship
By submitting payment and signing these engagement terms, you engage EPHQ as your counsel for the limited purpose of preparing and finalizing the selected estate planning documents.
Representation begins upon receipt of your payment and your signed engagement terms. It ends when (i) we have delivered your draft documents and you either approve them or fail to request changes within ten (10) days, or (ii) thirty (30) days pass—whichever occurs first—unless we both agree in writing to extend the engagement.
If no revision request is received within 10 days of draft delivery, we will assume the documents are satisfactory and close your file.
If this engagement involves two clients, the signing party represents that they are authorized to enter into these terms on behalf of both clients and that both clients have reviewed and agreed to these terms.
3. Costs and Payment
Payment in full is due before any services are provided. All pricing is disclosed up-front on our website and in the intake confirmation. Payments are made securely through our portal.
If you submit payment but have not yet completed the intake process, you may request an eighty percent (80%) refund within seven (7) days of payment. After that window, or once intake is complete and work has begun, no refunds will be issued.
If you submit payment but are domiciled outside of Virginia, the District of Columbia, Maryland, or West Virginia, you are not eligible for services and will receive an eighty percent (80%) refund of your payment. By submitting payment, you represent that you are a resident of one of our service jurisdictions and acknowledge that EPHQ’s services are limited to clients domiciled in Virginia, the District of Columbia, Maryland, or West Virginia.
Once draft documents have been provided to you, you agree that we have provided you with documents that can protect your legal interests and there are no refunds beyond that point.
4. Client Responsibilities
Provide complete and accurate information, respond promptly to follow-up questions, and review drafts within ten (10) days. All communications will be conducted via email. It is your responsibility to ensure that the email address provided at intake is accurate and monitored. EPHQ will provide signing instructions with your final documents. You are solely responsible for properly executing your documents in accordance with those instructions. EPHQ is not responsible for documents that are improperly executed or not executed at all.
EPHQ operates exclusively as a virtual law firm. All services are delivered remotely. We do not offer in-person meetings, and we do not provide notarization or witness services in connection with the execution of your documents.
5. Turnaround Times
Drafts are typically delivered within five (5) business days after we receive all requested information. Revisions are typically delivered within five (5) business days after request.
6. Revisions
Up to two complimentary revision rounds are included if requested within ten (10) days of draft delivery. After that window—or after the second round—additional changes may incur a fixed cost quoted in advance.
7. Conflicts of Interest
Due to the limited scope of this engagement, conflicts of interest are unlikely. However, if a conflict arises, we will notify you promptly. By engaging EPHQ, you acknowledge the limited nature of this representation and waive any conflict that may arise solely from EPHQ’s representation of other clients in similar, unrelated estate planning matters.
8. Confidentiality
All information you provide is kept completely confidential and will be used solely to deliver the agreed-upon legal services.
9. Governing Law
This engagement is governed by the laws of the Commonwealth of Virginia. Any dispute arising out of or related to these terms or the services provided shall be subject to the exclusive jurisdiction of the courts of the Commonwealth of Virginia.
10. Limitation of Liability
EPHQ’s liability is limited to the amount paid for the selected plan. If you believe there is a deficiency in the documents delivered, you must notify us in writing within thirty (30) days of delivery. We will make reasonable efforts to correct any error attributable to EPHQ at no additional charge.
11. Changes to These Terms
If we make a material change to these terms during our representation of you, we’ll email the update to the address on file at least ten (10) calendar days before it takes effect. Administrative edits to these terms (typos, address changes) may take effect immediately.
